TackNote — Terms of Service

1.Agreement

These Terms of Service (the "Terms") are an agreement between you and Buy It Now LLC, doing business as TackNote ("we," "us," or "our") covering your use of TackNote (the "app"). By downloading, installing, or using TackNote, or by buying a license, you agree to these Terms and to our End User License Agreement (the "EULA"). If you don't agree, please don't use TackNote.

2.The license you're buying

A one-time purchase of $24.99 USD grants you a personal, non-exclusive, non-transferable license to use TackNote on up to two (2) Macs that you own or control. The full terms of that license are set out in the EULA.

3.Free trial

TackNote includes a 14-day free trial — no card required. After the trial, a license is required to keep creating new notes. Your existing notes remain readable whether or not you buy a license.

4.Payment, taxes & refunds

Purchases are processed by Lemon Squeezy, who acts as the merchant of record and handles payment and any applicable taxes. Refund requests are handled in accordance with Lemon Squeezy's refund policy. If something's wrong with your purchase, email us at support@tacknote.app and we'll make it right.

5.Acceptable use

When using TackNote, you agree not to:

resell, redistribute, or sublicense the app;
share license keys beyond the two-Mac limit;
reverse engineer the app, except where the law expressly permits.

6.Updates & changes

We may release updates to TackNote and may change features or these Terms from time to time. Where it's practical, we'll note material changes. Your continued use of TackNote after changes take effect means you accept them.

7.Disclaimer of warranties

TackNote is provided "AS IS" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We don't warrant that the app will be uninterrupted, error-free, or fit for a particular purpose.

8.Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to TackNote or these Terms is limited to the amount you paid for TackNote. We are not liable for indirect, incidental, or consequential damages.

9.Governing law

These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-laws rules.

Note: The governing-law jurisdiction above (State of Idaho, USA) is a placeholder and should be confirmed with counsel before these Terms are relied upon.
